170. Introduction
AKBSTOCK respects the intellectual property rights of creators, artists, designers, businesses, copyright owners and other rights holders worldwide.
170.1 Copyright Complaint Procedure
This Copyright Complaint & DMCA Policy explains the procedure through which a person may report content available through AKBSTOCK that they reasonably believe infringes copyright.
170.2 Responsible Review
AKBSTOCK is committed to reviewing legitimate copyright concerns professionally, fairly and in good faith while also protecting Customers, licensees and other parties against unsupported, mistaken, misleading or abusive claims.
170.3 Procedural Nature
This Policy establishes a complaint and review procedure. It does not itself transfer copyright, determine ownership as a court of law, expand any License or replace the AKBSTOCK Copyright Policy or applicable License Agreements.
170.4 Jurisdiction
AKBSTOCK operates from India. References to the United States Digital Millennium Copyright Act ("DMCA") apply only where legally relevant or applicable and must not be interpreted as making every copyright complaint subject to United States law.
171. Purpose of This Policy
The purpose of this Policy is to provide a transparent, accessible and responsible mechanism for raising copyright concerns relating to AKBSTOCK.
171.1 Protection of Rights Holders
The procedure is intended to enable legitimate copyright owners and authorized representatives to identify and report potentially infringing content.
171.2 Protection Against Abuse
The procedure also seeks to protect Customers, licensees, creators and AKBSTOCK against false, unsupported, mistaken, fraudulent or bad-faith copyright claims.
171.3 Balanced Process
AKBSTOCK aims to preserve relevant evidence, review available information, take proportionate interim action where appropriate and reach a reasonable platform decision without prejudging disputed legal rights.
172. Scope of This Policy
This Policy applies to copyright complaints concerning Products, Product previews, digital artwork, Website content and other copyright-related material made available through official AKBSTOCK services where AKBSTOCK is reasonably able to review or control the material.
172.1 AKBSTOCK-Controlled Content
The procedure primarily concerns content hosted, published, distributed or otherwise controlled through AKBSTOCK.
172.2 Third-Party Content
Where unauthorized copies of AKBSTOCK or third-party material appear on services outside AKBSTOCK's control, removal may depend upon the relevant third-party platform and applicable law.
172.3 No Expansion of Authority
This Policy does not give AKBSTOCK authority to adjudicate disputes or control content hosted entirely by unrelated third parties.
173. Copyright Complaint Framework
AKBSTOCK generally handles copyright complaints through a structured review process.
173.1 General Stages
The process may include receipt of the complaint, completeness review, verification of authority where necessary, preliminary assessment, investigation, interim action where appropriate, outcome determination and review of any valid response or counter-notification.
173.2 Flexible Procedure
The exact stages used may vary depending upon the evidence, urgency, complexity, legal requirements and technical circumstances of the matter.
173.3 No Predetermined Outcome
Beginning or continuing an investigation does not mean that AKBSTOCK has determined that infringement occurred.
174. DMCA References & International Application
AKBSTOCK may receive copyright complaints from rights holders located in different jurisdictions.
174.1 DMCA Meaning
The term "DMCA" refers to United States law and is not used by AKBSTOCK as a universal name for every copyright complaint worldwide.
174.2 Applicable Statutory Procedures
Where a particular statutory notice regime legally applies to AKBSTOCK or a particular matter, AKBSTOCK may follow the requirements applicable to that situation.
174.3 No Safe-Harbour Representation
Nothing in this Policy represents or guarantees that AKBSTOCK qualifies for, relies upon or receives any particular statutory safe-harbour protection.
175. Who May Submit a Copyright Complaint
A copyright complaint should be submitted by a person having a legitimate connection to the rights being asserted.
175.1 Eligible Complainants
A complaint may generally be submitted by the copyright owner, an exclusive licensee where legally entitled to act, or a duly authorized representative of the relevant rights holder.
175.2 Verification
AKBSTOCK may request reasonable evidence demonstrating the complainant's ownership, legal interest or authority.
175.3 Mere Possession
Merely purchasing, possessing, commissioning, admiring or having access to a work does not necessarily establish copyright ownership or authority to submit a complaint.
176. Copyright Owner & Authorized Representative
A representative submitting a complaint should clearly identify the copyright owner and the basis upon which the representative is authorized to act.
176.1 Evidence of Authority
AKBSTOCK may request an authorization letter, agency confirmation, licence document, power of attorney or other reasonable evidence of authority where appropriate.
176.2 Disputed Authority
Where the authority of a representative is materially unclear or disputed, AKBSTOCK may suspend substantive review until sufficient clarification is provided.
177. Good-Faith Requirement
All complaints, responses and counter-notifications must be submitted honestly and in good faith.
177.1 Reasonable Consideration
Before alleging infringement, a complainant should reasonably consider whether the complained-of material may be licensed, authorized, independently created or subject to an applicable copyright exception or other lawful basis.
177.2 Honest Mistakes
A genuine complaint does not become abusive merely because AKBSTOCK ultimately concludes that infringement has not been sufficiently established.
178. Information Required in a Copyright Complaint
A copyright complaint should contain sufficient information to enable AKBSTOCK to understand and reasonably investigate the allegation.
178.1 Core Information
The complaint should ordinarily include the complainant's name and contact information, identification of the copyrighted work, identification of the challenged AKBSTOCK content, relevant URLs or Product IDs, an explanation of the alleged infringement and supporting evidence where available.
178.2 Additional Requirements
Where a particular statutory notice procedure applies, additional declarations, signatures or information required by that law may also be necessary.
179. Identification of the Copyrighted Work
The copyrighted work should be identified with sufficient specificity to permit meaningful review.
179.1 Useful Identifiers
Where available, the complainant should provide the title, creator, creation or publication information, registration information where relevant, and an authorized reference copy or reliable location of the work.
179.2 General Ideas or Styles
A broad claim concerning only a style, theme, technique, trend, idea or unidentified catalogue may be insufficient without identifying the protected expression allegedly copied.
180. Identification of the Allegedly Infringing AKBSTOCK Content
The complaint should clearly identify the AKBSTOCK material alleged to infringe.
180.1 Product Identification
Relevant information may include Product name, Product ID, Product URL, preview image, screenshot, page title or another reliable identifier.
180.2 Sufficient Precision
AKBSTOCK is not required to guess which Product is disputed where a complaint is too vague to locate the material.
181. Product URLs, Product IDs & Location Information
Product URLs, Product IDs and other location information should be supplied where reasonably available.
181.1 Changed or Unavailable Pages
If a URL has changed or is no longer publicly available, screenshots, archived references, order information or other identifying evidence may assist AKBSTOCK in locating the material.
181.2 Identification Only
The existence of a URL or Product ID identifies content for review and does not itself establish infringement.
182. Evidence of Copyright Ownership or Authority
AKBSTOCK may consider evidence reasonably relevant to authorship, copyright ownership, assignment, exclusive licensing or authority to act.
182.1 Examples of Evidence
Evidence may include original working files, dated drafts, source artwork, publication records, contracts, assignments, licences, registration records, invoices or relevant correspondence.
182.2 No Single Conclusive Format
No single category of evidence is automatically conclusive. Where applicable, copyright may exist without registration, and registration alone may not resolve every ownership dispute.
183. Supporting Documents & Evidence
Supporting evidence should be relevant, legible and reasonably organized.
183.1 Digital Evidence
AKBSTOCK may consider source files, metadata, timestamps, correspondence, screenshots, URLs, contracts, creation records and other relevant materials.
183.2 Evidentiary Limitations
Metadata, timestamps, screenshots and digital files may be incomplete, altered or capable of multiple interpretations and therefore will be considered together with other available evidence.
184. Statements, Declarations & Accuracy of Information
Information supplied in a complaint or counter-notification should be accurate to the submitter's knowledge and should not knowingly omit material information in a misleading manner.
184.1 Statutory Declarations
Where applicable law requires a particular declaration, signature, consent, statement under penalty of perjury or other formal element, the submitter remains responsible for satisfying that requirement.
184.2 Electronic Submissions
AKBSTOCK may accept electronic submissions for its internal administrative process without representing that every electronic submission satisfies every jurisdiction's statutory requirements.
185. How to Submit a Copyright Complaint
Formal copyright complaints should be submitted through the official AKBSTOCK copyright channel.
185.1 Submission
The complainant should use a clear subject line identifying the matter as a copyright complaint and include relevant Product identifiers, explanation and supporting evidence.
185.2 Duplicate Submissions
Submitting the same complaint repeatedly through multiple AKBSTOCK channels does not accelerate review and may create duplicate case records.
186. Official Copyright Contact
The official AKBSTOCK copyright contact is copyright@akbstock.com.
186.1 Copyright Matters
Formal copyright complaints, responses and copyright-related correspondence should be directed to this address.
186.2 Future Reporting Tools
AKBSTOCK may introduce an official online copyright reporting form or additional reporting channel and may update the Website accordingly.
187. Acknowledgement of Complaint
AKBSTOCK may acknowledge receipt of a copyright complaint electronically.
187.1 Receipt Is Not Approval
An acknowledgement, automated receipt, ticket number or support confirmation means only that the communication has been received or recorded and does not establish infringement.
187.2 Technical Failure
Where a submission cannot be processed because of a technical or delivery problem, AKBSTOCK may request resubmission.
188. Initial Review of Complaint
AKBSTOCK may conduct an initial administrative review before beginning a substantive investigation.
188.1 Initial Checks
AKBSTOCK may review whether the claimant, copyrighted work, challenged content, basis of complaint and sufficient contact information have been identified.
188.2 Preliminary Nature
Initial review is administrative and does not constitute a final legal determination.
189. Incomplete or Deficient Complaints
A complaint may be considered incomplete where information reasonably necessary for review is missing, unclear, materially inconsistent or not reasonably verifiable.
189.1 Opportunity to Correct
AKBSTOCK may request correction or additional information before proceeding.
189.2 Administrative Closure
AKBSTOCK may close a materially incomplete complaint without prejudice to submission of a properly completed complaint.
190. Requests for Additional Information
AKBSTOCK may request additional information from the complainant or another relevant party where reasonably necessary.
190.1 Relevant Information
Requests may concern ownership, authorization, dates, source files, licences, alleged copying, statutory exceptions, identity, authority or other matters relevant to the dispute.
190.2 Failure to Respond
Failure to provide reasonably requested information may affect AKBSTOCK's ability to continue or resolve the review.
191. Verification of Complainant Authority
Where authority is relevant or disputed, AKBSTOCK may seek reasonable verification that the complainant is entitled to assert the rights concerned.
191.1 Verification Methods
Verification may include contracts, authorization documents, licences, public records, business-domain correspondence or other reliable evidence.
191.2 Sensitive Documents
AKBSTOCK may seek to protect commercially sensitive information from unnecessary disclosure while retaining sufficient information for review.
192. Preliminary Assessment
AKBSTOCK may conduct a preliminary assessment to determine the appropriate next step.
192.1 Relevant Factors
AKBSTOCK may consider whether the claim appears facially plausible, whether the content can be located, whether the asserted rights are relevant and whether temporary action appears reasonably necessary.
192.2 Nature of Claim
AKBSTOCK may determine that a submission principally concerns trademark, privacy, contract, design rights or another issue rather than copyright and may handle or redirect it accordingly.
193. Copyright Investigation Process
Where sufficient information exists, AKBSTOCK may conduct a reasonable investigation based on the circumstances and evidence available.
193.1 Investigation Materials
The review may include Product records, source files, creation history, licences, communications, publication history, purchase records, timestamps and relevant external information.
193.2 Evidence Preservation
AKBSTOCK may preserve relevant records while the matter is under review.
193.3 Administrative Investigation
AKBSTOCK's investigation is a platform-administration process and is not equivalent to judicial discovery or formal legal fact-finding.
194. Review of AKBSTOCK Creation & Ownership Records
AKBSTOCK may review internal records relating to the creation, acquisition, publication or ownership of the challenged Product.
194.1 Records
Relevant records may include sketches, scans, working files, drafts, revisions, contributor information, agreements, invoices, internal review information and publication records.
194.2 Evidentiary Weight
Internal records may support AKBSTOCK's position but their existence does not automatically defeat credible contrary evidence.
195. Review of Third-Party Licenses & Permissions
Where relevant, AKBSTOCK may review licences, assignments, permissions, contributor agreements or other documentation concerning third-party material.
195.1 Scope of Permission
The scope, territory, duration, exclusivity and restrictions of the relevant authorization may be considered.
195.2 Confidential Terms
AKBSTOCK is not required to publicly disclose commercially sensitive agreements merely because they are considered during an investigation, except where disclosure is legally required.
196. Comparison of Relevant Works
AKBSTOCK may compare the relevant works as part of its administrative review.
196.1 Relevant Expression
Comparison may focus on the expression alleged to have been copied rather than broad resemblance alone.
196.2 Additional Context
Chronology, source material, access, common references, licensed elements and evidence of independent creation may also be considered where relevant.
197. Independent Creation, Similarity & Common Design Elements
Textile and surface designs may contain flowers, leaves, paisleys, geometric forms, traditional elements, common layouts, colour trends and other visual elements that may independently appear in many works.
197.1 Similarity Alone
Visual similarity alone does not automatically establish copying or copyright infringement.
197.2 Minor Changes
Conversely, merely changing colour, scale, orientation, arrangement or minor details does not automatically make otherwise infringing copying lawful.
197.3 Case-by-Case Review
Each matter will be considered according to its evidence, protected expression and applicable law.
198. Communication With Relevant Parties
AKBSTOCK may communicate with persons reasonably connected to the complaint.
198.1 Relevant Parties
Such persons may include the complainant, Customer, creator, contributor, licensor, authorized representative, service provider or professional adviser.
198.2 Restricted Disclosure
Communication may be limited where disclosure would compromise privacy, security, evidence preservation, legal obligations or a lawful investigation.
199. Temporary Product Restriction During Investigation
AKBSTOCK may temporarily restrict a challenged Product while an investigation is pending where reasonably appropriate.
199.1 Possible Restrictions
Temporary measures may include hiding a Product listing, disabling purchase, restricting access or otherwise reducing availability.
199.2 Proportionality
AKBSTOCK may also determine that temporary restriction is unnecessary where the circumstances do not reasonably justify such action.
200. Temporary Suspension of Downloads
AKBSTOCK may temporarily suspend new downloads of a challenged Product while preserving internal access required for investigation and evidence retention.
200.1 Existing Customers
The effect of a temporary suspension on existing Customers will depend upon the applicable License, legal requirements and circumstances.
200.2 Protective Measure
Temporary download suspension is an administrative protective measure rather than a determination of infringement.
201. No Admission From Temporary Restriction
Temporary removal, hiding, restriction or suspension does not constitute an admission by AKBSTOCK that copyright infringement occurred.
201.1 Continued Availability
Likewise, keeping content available during initial review does not constitute a finding that a complaint lacks merit.
201.2 Interim Nature
Interim decisions remain subject to further investigation and review.
202. Investigation Time & Case Complexity
AKBSTOCK does not guarantee a fixed investigation period because copyright disputes can vary substantially in complexity.
202.1 Relevant Factors
Timing may depend upon the number of works, evidence quality, response times, language, cross-border issues, historical records, third-party permissions and legal proceedings.
202.2 Reasonable Efforts
AKBSTOCK will seek to handle complaints within a reasonable period having regard to the circumstances.
203. Investigation Outcomes
Following review, AKBSTOCK may reach one or more administrative outcomes.
203.1 Possible Outcomes
AKBSTOCK may restore a Product, maintain it without change, correct information, modify availability, restrict future licensing, permanently remove it or take another reasonable action.
203.2 New Evidence
An outcome may be reconsidered where material new evidence, a valid legal notice, counter-notification, settlement or court order later becomes available.
204. Restoration of Product
AKBSTOCK may restore a restricted Product where continued restriction is no longer reasonably justified.
204.1 Grounds for Restoration
Restoration may occur where a complaint is withdrawn, mistaken, unsupported, satisfactorily answered or otherwise resolved.
204.2 No Absolute Certification
Restoration does not certify that no person could ever assert rights concerning the Product.
205. Product Information or Licensing Corrections
Where appropriate, AKBSTOCK may correct Product titles, descriptions, attribution, licensing information, metadata or other information.
205.1 Correction Without Admission
Correcting information does not necessarily constitute an admission of copyright infringement or liability.
205.2 Customer Rights
Any material change affecting a Customer's existing License will be considered consistently with the applicable License Agreement and mandatory law.
206. Permanent Removal of Product
AKBSTOCK may permanently remove or cease offering a Product where removal is reasonably appropriate or legally required.
206.1 Grounds
Removal may occur where available evidence supports it, rights cannot reasonably be verified, a lawful order requires it or continued distribution creates unacceptable legal or platform risk.
206.2 Record Preservation
AKBSTOCK may retain internal records of removed material where reasonably necessary for legal, compliance, evidentiary or fraud-prevention purposes.
207. Other Corrective Actions
AKBSTOCK may take additional proportionate corrective action where appropriate.
207.1 Available Measures
Measures may include restricting future licensing, correcting records, preserving evidence, changing technical access, communicating with relevant parties, restricting accounts or cooperating with lawful authorities.
207.2 Proportionate Response
AKBSTOCK is not required to impose the maximum possible action in every case.
208. Existing Customers & Previously Granted Licenses
A later copyright complaint or Product removal does not automatically determine the legal status of every License previously granted for that Product.
208.1 Relevant Factors
Existing rights may depend upon the applicable License Agreement, underlying ownership, mandatory law, any settlement or court order and the circumstances of the transaction.
208.2 No Automatic Guarantee
AKBSTOCK does not guarantee that every previously granted License can remain legally effective following an adverse ownership determination by a competent authority.
209. Customer Notification Where Appropriate
AKBSTOCK may notify affected Customers where a copyright issue materially affects continued access, licensing or use of a previously acquired Product.
209.1 Appropriate Notification
Notification may not be necessary where the matter remains confidential or unresolved or does not materially affect the Customer.
209.2 Current Contact Details
Customers are responsible for maintaining reasonably current contact information in their AKBSTOCK Account.
210. Counter-Notification & Response to a Complaint
A person whose Product, content or rights are affected by a copyright complaint may be permitted to submit a response or counter-notification where appropriate.
210.1 Purpose
The response should explain why the complaint or resulting restriction is disputed and should provide relevant supporting information.
210.2 Statutory Counter-Notices
Where a particular statutory counter-notice procedure applies, the submitting party remains responsible for satisfying its legally required elements.
211. Who May Submit a Counter-Notification
A counter-notification should be submitted only by a person having a legitimate basis to dispute the complaint or restriction.
211.1 Appropriate Parties
This may include the affected rights holder, Product owner, creator, authorized representative or another person whose legitimate rights are directly affected.
211.2 Verification
AKBSTOCK may request reasonable evidence of identity or authority.
212. Information Required in a Counter-Notification
A counter-notification should contain sufficient information for AKBSTOCK to understand the basis of the dispute.
212.1 Core Information
It should ordinarily identify the affected Product, original complaint or case where available, contact information, explanation supporting the counter-claim and relevant evidence.
212.2 Legal Requirements
Additional declarations, signatures, consent or other information may be required where a specific statutory counter-notice regime applies.
213. Supporting Evidence for a Counter-Claim
A counter-claim should be supported by relevant evidence where reasonably available.
213.1 Examples
Evidence may include source files, drafts, licences, permissions, ownership documents, correspondence, publication history or evidence of independent creation.
213.2 Substantive Response
A bare assertion that the complainant is wrong may be insufficient where the disputed facts reasonably require supporting evidence.
214. Review of Counter-Notification
AKBSTOCK may review a counter-notification together with the original complaint, investigation record and any additional evidence.
214.1 Additional Review
AKBSTOCK may request further information from either party and may maintain temporary restrictions during review.
214.2 No Guaranteed Restoration
Receipt of a counter-notification does not automatically guarantee restoration of the Product.
215. Restoration Following a Disputed Claim
AKBSTOCK may restore affected content where the available information reasonably supports restoration.
215.1 Continued Restriction
Restoration may be delayed or withheld where a lawful court order, applicable statutory procedure, unresolved material risk or other lawful basis requires continued restriction.
215.2 External Remedies
Restoration does not prevent either party from pursuing lawful remedies outside AKBSTOCK.
216. Competing Ownership Claims
Where multiple parties present credible competing claims of ownership, AKBSTOCK may be unable to determine the ultimate legal owner through an internal review.
216.1 Unresolved Disputes
AKBSTOCK may maintain restrictions, seek additional evidence or require an appropriate legal resolution before taking further action.
216.2 No Manufactured Certainty
AKBSTOCK will not represent an uncertain ownership dispute as conclusively resolved merely for administrative convenience.
217. Matters Requiring Court or Legal Authority Resolution
Certain disputes may require determination by a competent court, tribunal or lawful authority.
217.1 Complex Legal Disputes
This may include conflicting assignments, contracts, authorship claims, succession issues, competing ownership interests or other complex factual or legal questions.
217.2 Lawful Orders
AKBSTOCK may comply with valid and legally binding orders applicable to it.
218. Indian Copyright Notice Procedures Where Applicable
Because AKBSTOCK operates from India, applicable Indian copyright law may be relevant to copyright complaints and platform decisions.
218.1 Copyright Act, 1957
Indian copyright matters may be governed by the Copyright Act, 1957, together with applicable rules, amendments and other law.
218.2 Specific Statutory Procedures
Where Indian law establishes a particular notice procedure for a defined situation, the statutory requirements applicable to that situation will prevail over inconsistent wording in this Policy.
218.3 No Generic Indian DMCA
AKBSTOCK does not represent the specific procedure concerning transient or incidental storage under Section 52(1)(c) and the applicable Copyright Rules as a universal takedown procedure for every copyright dispute.
219. DMCA Notice Procedures Where Applicable
Where United States DMCA procedures are legally applicable to a particular matter, AKBSTOCK may consider a notice or counter-notice submitted in the legally applicable form.
219.1 Submitter Responsibility
A person specifically invoking the DMCA remains responsible for satisfying the legal requirements applicable to their notice.
219.2 Incomplete DMCA Notices
AKBSTOCK may request clarification or additional information where a purported statutory notice is incomplete or its applicability is unclear.
220. No Universal Application of U.S. DMCA Procedures
The United States DMCA does not automatically govern every AKBSTOCK Customer, transaction, Product, complaint or copyright dispute.
220.1 Terminology Does Not Determine Law
Using terms such as "DMCA", "takedown" or "counter-notice" does not by itself determine the governing law or create statutory rights outside their proper legal scope.
220.2 International Framework
AKBSTOCK's general complaint process is intended to accommodate international complaints while remaining subject to the laws actually applicable to the matter.
221. Copyright Exceptions, Limitations & Lawful Uses
AKBSTOCK recognizes that copyright law may contain exceptions, limitations, licences and other lawful bases for use of protected material.
221.1 Consideration of Lawful Use
AKBSTOCK will not intentionally treat every use lacking express permission as automatically infringing where an applicable legal exception or authorization may apply.
221.2 Mandatory Rights
Nothing in this Policy is intended to exclude or restrict a copyright exception, limitation or mandatory legal right that cannot lawfully be excluded.
222. Fair Dealing & Other Statutory Exceptions
Indian copyright law recognizes specified fair-dealing and other statutory exceptions under Section 52 of the Copyright Act, 1957.
222.1 Case-Specific Application
Whether a particular exception applies depends upon the applicable legal provision and facts of the case.
222.2 No Private Percentage Rule
AKBSTOCK does not establish a universal percentage-change, similarity-score or other private formula as a substitute for applicable copyright law.
223. False, Misleading or Fraudulent Copyright Claims
Knowingly false, materially misleading, fabricated or fraudulent copyright claims are prohibited.
223.1 Examples
Examples may include impersonating a rights holder, fabricating ownership records, knowingly identifying unrelated content, manipulating material evidence or knowingly asserting rights the complainant does not possess.
223.2 Action
AKBSTOCK may reject fraudulent claims, preserve relevant evidence, restrict accounts or complaint privileges and take other appropriate action consistent with applicable law.
224. Abusive or Bad-Faith Complaints
Copyright procedures must not knowingly be used for harassment, retaliation, unfair competitive interference or another improper purpose.
224.1 Improper Purposes
Examples may include knowingly attempting to suppress lawful competition, obtain unrelated confidential information, interfere with legitimate business or pressure another party concerning an unrelated dispute.
224.2 Pattern of Conduct
AKBSTOCK may consider repeated conduct and surrounding circumstances when assessing potential abuse.
225. Good-Faith Mistakes & Unsuccessful Complaints
An honest copyright complaint may ultimately be rejected, withdrawn or disproved without becoming an abusive complaint.
225.1 Distinguishing Mistakes From Abuse
AKBSTOCK may consider available evidence, conduct, corrections, repeated behaviour and surrounding circumstances when distinguishing a genuine mistake from deliberate misuse.
225.2 Correction
Parties are encouraged to correct material errors promptly after discovering them.
226. Repeat Copyright Abuse
Repeated misuse of AKBSTOCK's copyright complaint process may result in additional safeguards or restrictions.
226.1 Repeated Misuse
Repeat abuse may include fabricated claims, impersonation, deliberate misidentification, manipulated evidence or recurring use of copyright complaints for improper purposes.
226.2 Proportionate Measures
AKBSTOCK may consider the seriousness, frequency and context of previous incidents rather than applying a purely mechanical numerical rule.
227. Repeat Infringers & Repeated Violations
AKBSTOCK may take appropriate action against users or account holders who repeatedly engage in substantiated copyright infringement or serious intellectual-property violations.
227.1 Complaint Alone Is Insufficient
A person does not automatically become a repeat infringer merely because multiple allegations have been submitted against them.
227.2 Relevant Evidence
AKBSTOCK may consider substantiated findings, admissions, valid orders, reliable evidence and the circumstances of previous incidents.
228. Account Restrictions, Suspension & Termination
AKBSTOCK may restrict, suspend or terminate an Account where reasonably justified by serious or repeated copyright-related violations or abuse.
228.1 Proportionate Action
Measures may be temporary or permanent and may be limited to particular functions where appropriate.
228.2 Existing Obligations
Suspension or termination does not automatically eliminate obligations, liabilities or rights that accrued before the action was taken.
229. Confidentiality & Responsible Information Handling
AKBSTOCK will seek to handle copyright complaint information responsibly and limit unnecessary disclosure.
229.1 No Absolute Confidentiality
Absolute confidentiality cannot be guaranteed because relevant information may need to be shared with affected parties, professional advisers, service providers, courts or lawful authorities.
229.2 Sensitive Information
Submitters should avoid providing unrelated sensitive personal information, confidential material or trade secrets unless reasonably necessary to support the matter.
230. Sharing Information With Relevant Parties
AKBSTOCK may share relevant information with persons whose involvement is reasonably necessary to investigate or resolve a copyright matter.
230.1 Limited Disclosure
Where reasonably practical, unnecessary sensitive information may be withheld or redacted.
230.2 Legal Disclosure
Information may be disclosed where required by applicable law, valid legal process, court order or another lawful obligation.
231. Privacy & Personal Information
Personal information associated with copyright complaints will be handled consistently with the AKBSTOCK Privacy Policy and applicable data-protection requirements.
231.1 Complaint Data
Complaint records may include names, contact details, signatures, correspondence, technical information, evidence and other information submitted or generated during review.
231.2 No Automatic Public Disclosure
Submitting a complaint does not authorize public disclosure of all personal information contained in the submission.
232. Complaint Records & Evidence Retention
AKBSTOCK may retain copyright complaint records for legitimate legal, compliance and business purposes.
232.1 Records
Records may include complaints, counter-notifications, correspondence, evidence, Product records, internal review notes and outcome information.
232.2 Retention Period
Retention periods may vary according to legal obligations, dispute-resolution needs, fraud prevention, evidence preservation and the nature of the matter.
232.3 Removed Content
Relevant evidence may lawfully be retained even after public content is removed or an Account is closed.
233. Cooperation With Courts & Lawful Authorities
AKBSTOCK may cooperate with courts, law-enforcement agencies, regulators and other lawful authorities where required or reasonably appropriate under applicable law.
233.1 Legal Process
AKBSTOCK may preserve or disclose relevant information in response to valid legal process and may seek clarification or challenge a request where legally permitted and appropriate.
233.2 Private Requests
This provision does not require AKBSTOCK to disclose confidential information merely because a private party requests it.
234. No Determination as a Court of Law
AKBSTOCK is not a court, tribunal or governmental copyright authority.
234.1 Administrative Decisions
AKBSTOCK's internal review determines what platform action it considers appropriate based on reasonably available information.
234.2 No Binding Judgment
An AKBSTOCK decision does not constitute a binding judicial determination of copyright ownership, infringement, damages or liability between private parties.
235. No Guarantee of Particular Outcome
Submitting a copyright complaint does not guarantee any particular outcome.
235.1 No Guaranteed Remedy
AKBSTOCK does not guarantee removal, restoration, compensation, settlement, account termination or any other specific result.
235.2 External Distribution
AKBSTOCK cannot guarantee prevention of all unauthorized copying, third-party distribution or future disputes concerning digital content.
236. International Copyright Complaints
AKBSTOCK may receive copyright complaints from rights holders located throughout the world.
236.1 Different Legal Systems
Copyright ownership rules, exceptions, remedies, formalities and notice procedures may differ between jurisdictions.
236.2 Jurisdiction-Specific Information
AKBSTOCK may request additional information where the complainant relies upon rights or procedures specific to a particular jurisdiction.
236.3 International Availability
The international availability of AKBSTOCK does not mean that every country's procedural law simultaneously governs every transaction or complaint.
237. Third-Party Platforms, Hosts & Service Providers
AKBSTOCK-related material may appear on search engines, hosting providers, social-media services, marketplaces, payment services or other third-party platforms.
237.1 Independent Procedures
Third parties control their own notice, removal, appeal, account and enforcement procedures.
237.2 Direct Reporting
A rights holder may need to use the relevant third party's official intellectual-property reporting procedure directly.
237.3 No Control Guarantee
AKBSTOCK cannot guarantee that an unrelated third party will accept or act upon a complaint submitted only to AKBSTOCK.
238. Relationship With AKBSTOCK Copyright Policy
This Copyright Complaint & DMCA Policy should be read together with the AKBSTOCK Copyright Policy.
238.1 Copyright Policy
The Copyright Policy principally addresses ownership, protected material, licensing boundaries, prohibited uses and copyright-enforcement principles.
238.2 This Policy
This document principally governs the procedural handling of copyright complaints, investigations, responses, counter-notifications and disputed claims.
239. Relationship With AKBSTOCK License Agreements
This Policy does not replace the AKBSTOCK Commercial License Agreement, Subscription License Agreement, Exclusive License Agreement or applicable Free Product terms.
239.1 No Automatic License Change
A copyright complaint does not by itself automatically cancel, expand, transfer or modify a License.
239.2 Continued Compliance
Licensees remain responsible for complying with the applicable License Agreement unless AKBSTOCK communicates a valid change or restriction or applicable law requires otherwise.
240. Relationship With Other AKBSTOCK Legal Documents
